TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale are entered into by GRIFFE JOYAUX, a limited liability company registered with the Pontoise Trade and Companies Register under number 913.919.825, whose registered office is located at 15 rue des Clairières Rouges, 95000 Cergy, France. The company is represented by Mrs. Clara Le Toullec as manager, duly authorized to enforce this agreement, hereinafter referred to as "the Seller" or "the Company."

On the other hand, these Terms and Conditions of Sale apply to any natural or legal person purchasing products or services from GRIFFE JOYAUX, hereinafter referred to as "the Buyer" or "the Client."

PREFACE

The Seller offers, through its website www.griffejoyaux.com, a range of products, accessories, and tools for cosmetic or aesthetic use, aimed at both individuals and professionals. The list and descriptions of the goods and services offered by GRIFFE JOYAUX can be consulted on the aforementioned website.


ARTICLE 1 – PURPOSE AND GENERAL PROVISIONS

These Terms and Conditions of Sale define the rights and obligations of all parties in the context of the online sale of Products offered by the Seller. These Terms and Conditions of Sale (T&Cs) apply to all product sales conducted through the Company's website and form an integral part of the contract between the Buyer and the Seller.

The Seller reserves the right to revise these contents at any time by publishing a new version on its website. The applicable T&Cs are those in force at the time of payment for the order. These T&Cs are freely accessible on the Seller’s website, and it is the Buyer’s responsibility to review them before placing an order.

The Client declares they are legally capable of entering into a contract under French law or validly representing the individual or legal entity they represent. Unless proven otherwise, the information recorded by the Seller constitutes proof of all transactions.


ARTICLE 2 – PRODUCTS

The website is generally accessible continuously, every day of the year, 24 hours a day. However, suspensions or interruptions may occur, disrupting its use due to IT maintenance or technical improvements to the website, or for reasons beyond the Company’s control (force majeure or unforeseen events). Griffe Joyaux cannot be held responsible for any consequences resulting from temporary or prolonged unavailability of the website for any reason.

The essential characteristics of the goods and services and their respective prices are available on the website www.griffejoyaux.com and can be freely consulted by the Buyer. The Seller undertakes to honor the Client's order within the limits of available stock. However, the shopping cart does not constitute a reservation, and stock shortages may occur before the order is finalized. Griffe Joyaux strives to provide accurate and faithful product photos. However, image colorimetry and resolution parameters may vary depending on electronic devices, potentially causing differences between the images and the physical products. Consequently, the photos are non-contractual.


ARTICLE 3 – PRICES

The prices of the products sold on the www.griffejoyaux.com website are displayed in euros (€), including VAT. The price is explicitly stated for each product on its description page, as well as on the cart and order pages.

Shipping fees vary depending on your geographical location and the weight of your order. Shipping costs will be displayed at checkout. Access to the www.griffejoyaux.com website is also the Client’s responsibility.

Griffe Joyaux reserves the right to modify its prices at any time. In the event of a pricing error, whether due to a computer bug, human error, or technical issue, the order—even if validated by Griffe Joyaux—will be canceled. The user will be informed as soon as possible and may reorder at the corrected price.


ARTICLE 4 – ORDERING

To place an order, the Client must follow specific steps for each product offered by the Seller. The systematic steps are described below:

  1. The Client adds a chosen product to their cart.
  2. Before finalizing and validating the order, the Client can manage their cart, delete or modify its contents, review, and accept these Terms and Conditions of Sale.
  3. If the Client has a promotional code, they must enter it in the designated field to apply it.
  4. The Client provides their details and/or logs into their account to select a delivery method.

The order is considered final after payment validation. The Client certifies they have received details of shipping fees, payment methods, delivery, and contract execution terms.

Upon order confirmation, the Client will receive a payment confirmation email and an order acknowledgment.

Delivery of the products will be made by the selected method to the address provided during the order process. The Client agrees to provide accurate identification information to ensure proper order processing, in compliance with Article 1316-1 of the French Civil Code.

The transfer of risks, including loss and damage of ordered products, occurs when the Seller hands the products to the carrier, leaving the Seller's premises or warehouses.

The Seller reserves the right to refuse an order deemed abnormal, made in bad faith, or for any other legitimate reason.

These contractual details are written in French. In accordance with French law, they are summarized and confirmed when the order is validated. Except for exceptional circumstances, the rights granted under this Contract are given only to the individual who placed the order (or the person associated with the email address used for correspondence).


ARTICLE 5 – RETENTION OF TITLE

The products remain the property of the Seller until full payment is made, including any applicable shipping costs. This clause does not prevent the transfer of risks of loss or damage of the products, which become the Client’s responsibility upon delivery to the carrier.


ARTICLE 6 – DELIVERY

Orders are prepared and shipped within 2 to 4 working days (excluding Saturdays and Sundays). The delivery method offered is hand-delivery against a signature.

For deliveries within metropolitan France, the estimated delivery time is generally 2 to 3 working days, excluding processing and preparation time. Note that this timeframe is indicative, and delays will not result in refunds.

For deliveries outside metropolitan France, the user is considered the product importer and must pay any additional taxes.

Delivery times may be extended during sales periods, holidays, or exceptional events such as force majeure, health crises, states of emergency, or strikes.

Orders are processed based on available stock or supplier availability. If an item is unavailable for over 30 business days, we will inform you and offer cancellation. You may then request a store credit or refund for the item.

Once the delivery status is marked as "delivered" by the carrier, we are no longer responsible for the parcel. The risks of loss or damage to the products are transferred to the client as soon as they take physical possession of the products. It is the client's responsibility to notify the carrier of any issues with the delivered product. Please ensure you open and check the parcel before signing. After the client's signature, no claims can be made.

If the delivery is delayed by more than 15 days, the client may terminate the contract in accordance with Article L 138-2 of the French Consumer Code. In such cases, we will reimburse the product and the shipping costs ("to" costs) as stated in Article L 138-3 of the French Consumer Code.

If a package is not collected by the client in time and is returned to the seller, reshipping costs will be borne by the client. Return shipping costs are also the client’s responsibility in all cases unless the product is defective or not in conformity with the order.

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with Article L. 121-20 of the French Consumer Code, for items eligible for return, consumers have a period of fourteen full days to exercise their right of withdrawal without having to provide any reason or pay any penalties, except for return shipping costs, if applicable. The withdrawal period begins on the day of receipt of the goods.

However, due to the nature of the products we sell, we do not offer exchanges or refunds for items in our "Gels & Liquid Preparation" collections or "Griffe Tips."

To exercise the right of withdrawal, the client must contact the seller at contact@griffejoyaux.com. If the right of withdrawal is exercised within the specified period, only the price of the purchased product(s) and the initial shipping costs will be refunded. Return shipping costs will remain the client's responsibility. Returned products must be in their original condition and complete (packaging, accessories, instructions, etc.) to be resold as new and, whenever possible, include a copy of the proof of purchase.

For the refund process, the seller agrees to reimburse the client within 15 days of receiving the returned merchandise.

Claims must be reported to the seller within 24 hours of receiving the goods. Any return for reasons other than a defective item will be at the buyer's expense. Partial returns of items sold in sets, kits, or collections will not be accepted.


ARTICLE 8 – PAYMENT

Payment is required immediately upon placing an order. Payments can be made by credit card or PayPal. The buyer's account will be debited at the time of the order for products or services available and sent.

Upon request, a paper invoice that includes VAT will be sent to the buyer.


ARTICLE 9 – WARRANTIES

Under the law, the seller provides two guarantees:

  1. A compliance warranty
  2. A warranty against hidden defects in the products

The seller will refund or exchange defective products or those not conforming to the order. The client may choose between repair or replacement of the product, subject to the cost conditions outlined in Article L. 211-9 of the French Consumer Code. The legal compliance warranty applies independently of any commercial warranty.

The seller also guarantees against hidden defects in the products sold that render them unfit for use or significantly diminish their usability. The legal warranty against hidden defects applies in accordance with Articles 1641 and subsequent articles of the French Civil Code.

Warranty claims must be submitted via email to contact@griffejoyaux.com, accompanied by proof and photos of the defects. The seller reserves the right to verify the validity of the claim before accepting the product's return. If accepted, return shipping costs will be covered by the seller, and the product will be refunded or exchanged promptly.


ARTICLE 10 – INTELLECTUAL PROPERTY RIGHTS

All trademarks, domain names, products, software, images, videos, text, or any other intellectual property rights remain the exclusive property of the seller. No intellectual property rights are transferred through these T&Cs. Any reproduction, modification, or use of these elements, for any reason, is strictly prohibited without prior written authorization from the seller, subject to legal action.


ARTICLE 11 – ARCHIVING

Griffe Joyaux will keep records of orders and invoices on a reliable and durable medium, constituting an exact copy in accordance with Article 1348 of the French Civil Code. The computerized records of Griffe Joyaux will be considered as proof of communications, orders, payments, and transactions between the parties.


ARTICLE 12 – LIABILITY

By placing an order on the website, you acknowledge and accept the standard practices of the internet, including technical performance, response times, connection, query, or data transmission issues, risks of interruptions, contamination by viruses, and all other risks related to internet use. Griffe Joyaux is not responsible for direct or indirect damages resulting from improper use and/or malfunctioning of the computer, internet access, server, telephone line, or any other technical connection. Access to the site is at the user’s sole risk.


ARTICLE 13 – FORCE MAJEURE

Griffe Joyaux cannot be held responsible for the total or partial non-fulfillment of its obligations due to force majeure, unforeseen circumstances, or exceptional situations (e.g., health crises, emergencies, strikes). The seller will notify the client of such an event as soon as possible.


ARTICLE 14 – PERSONAL DATA PROTECTION

In accordance with the General Data Protection Regulation (GDPR) and French Data Protection Law of January 6, 1978, the client has the right to access, rectify, oppose, limit, and delete their personal data. By agreeing to these T&Cs, the client consents to the collection and use of their personal data for the execution of this contract.

Client data is confidentially collected and processed by Griffe Joyaux. It will not be sold, exchanged, or rented to third parties.

When the client provides their email address, they agree to receive information about the company’s products and promotions. Clients may unsubscribe at any time via the link in the email footer or by emailing contact@griffejoyaux.com.


ARTICLE 15 – APPLICABLE LAW

All terms in these T&Cs and any associated commercial transactions are governed by French law.


ARTICLE 16 – TERMINATION

16.1 Termination for Breach

In case of non-compliance with the T&Cs, the aggrieved party may notify the other party and demand compliance within 30 days. Failure to comply allows the aggrieved party to terminate the contract.

16.2 Termination for Convenience

Either party may terminate the contract at any time without reason by sending a registered letter with acknowledgment of receipt. Termination will take effect 15 days after receipt of the letter.


ARTICLE 17 – JURISDICTION

In case of disputes, parties will first seek an amicable resolution. If unresolved within 30 days, disputes will be submitted to the competent courts of the seller's location. These T&Cs are subject to French law.
