Terms and conditions of sale
Preface
These Terms and Conditions of Sale are concluded between GRIFFE JOYAUX, registered with the Pontoise Trade and Companies Register under number 913.919.825, with its registered office at 15 rue des Clairières Rouges, 95000 Cergy, represented by Ms Clara Le Toullec as manager, and any individual or legal entity purchasing its products or services.
The Seller markets products, accessories and tools for cosmetic or beauty use by individuals and professionals on www.griffejoyaux.com.
Article 1 - Purpose
These Terms determine the parties' rights and obligations for online sales. They apply to all sales made through the website and form an integral part of the contract. The applicable version is the one in force on the payment date. The Client declares that they can legally enter into a contract.
Article 2 - Products
The website may be interrupted for maintenance, technical improvements, force majeure or other unforeseen events. Essential characteristics and prices are available on the website. Orders are fulfilled subject to stock availability; a shopping cart does not reserve stock. Photographs are presented with care but are not contractually binding.
Article 3 - Prices
Prices are in euros, including VAT. Shipping costs depend on the destination and order weight and are shown at checkout. Griffe Joyaux may change its prices at any time. An order with an obviously incorrect price may be cancelled and placed again at the corrected price.
Article 4 - Orders
The Client adds products to their cart, checks or edits it, accepts the Terms, enters their contact details and selects a delivery method. The order becomes final once payment is validated. Confirmation is sent to the email address provided. The Seller may refuse an abnormal order, an order placed in bad faith or an order for any other legitimate reason.
Article 5 - Retention of title
Products remain the Seller's property until full payment, including delivery charges. Risks of loss and damage transfer to the Client when the products are handed to the carrier.
Article 6 - Delivery
Orders are prepared and shipped within 2 to 4 working days. In metropolitan France, delivery generally takes 2 to 3 working days, excluding preparation. These periods may be extended during promotions or exceptional circumstances.
For international orders, the Client is considered the importer and bears any applicable taxes. Once the carrier indicates delivery, the Client is responsible for raising any reservations. An uncollected parcel that is returned incurs reshipping costs payable by the Client. Delivery contact: contact@griffejoyaux.com.
Article 7 - Withdrawal and returns
The Client has fourteen days from receipt to exercise their right of withdrawal, excluding return shipping costs. For hygiene reasons, unsealed nail tips, gels and liquids, personalised products, and damaged or incomplete products are excluded.
The product must be new, unused, unopened and returned in its intact original packaging. The request must be sent before the deadline to GRIFFE JOYAUX, 15 rue des Clairières Rouges, 95000 Cergy, or contact@griffejoyaux.com. Following validation, the refund is made within fourteen days using the original payment method.
Article 8 - Payment
Payment is due immediately after ordering and may be made by bank card, Apple Pay or PayPal. The Buyer's account is debited when the order is placed. An invoice showing VAT may be provided on request.
Article 9 - Warranties
The Seller provides the statutory guarantees of conformity and against hidden defects. Any request must be emailed to contact@griffejoyaux.com with supporting evidence and photographs. Following validation, the Seller covers return costs and refunds or exchanges the product.
Article 10 - Intellectual property
Trademarks, domain names, products, software, images, videos, texts and other protected content remain the Seller's exclusive property. Any reproduction, modification or use without prior written authorisation is prohibited.
Article 11 - Records
Griffe Joyaux keeps orders and invoices on a reliable, durable medium. Its computerised records constitute evidence of communications, orders, payments and transactions between the parties.
Article 12 - Liability
The Client acknowledges the risks and technical constraints of the internet. Griffe Joyaux is not liable for direct or indirect damage resulting from misuse or malfunction of equipment, internet access, servers or any other technical connection.
Article 13 - Force majeure
Griffe Joyaux cannot be held liable for failure to perform its obligations resulting from force majeure, unforeseen events or exceptional circumstances. The Client will be informed as soon as possible.
Article 14 - Personal data
Under the GDPR and the French Data Protection Act, the Client has rights of access, rectification, objection, restriction and deletion. Data is processed confidentially, is not sold and is used for the stated purposes. Marketing subscriptions may be cancelled using the link in emails or by contacting contact@griffejoyaux.com.
Article 15 - Applicable law
These Terms and all commercial transactions mentioned in them are governed by French law.
Article 16 - Termination
In the event of a breach, the injured party may formally demand that the other party fulfil its obligations within thirty days, then terminate the contract if this fails. Either party may also terminate the contract by registered letter with acknowledgement of receipt, effective fifteen days after receipt.
Article 17 - Disputes
The parties undertake to seek an amicable solution. If no agreement is reached within thirty days, the dispute is brought before the competent courts. These Terms are governed by French law.
